Why Does the Uniform Code Matter to a Seller?
Oceana Is Not the Only Installation
Virginia Beach's overlay is the one most discussed and it is not the only military compatibility framework in the region. Other installations across Hampton Roads carry their own compatibility considerations, and Virginia requires notice where a parcel lies within an airport noise overlay zone.
So an owner in Norfolk or Chesapeake should not assume that being outside Virginia Beach means being outside any such framework. It means asking a different city the same question.
How Do I Find out Which Applies?
We publish no zoning requirements, overlay mappings or compatibility determinations for the individual Hampton Roads cities. Each administers its own and each will state the current position for an address.
Seven Cities, One Statute
Norfolk, Chesapeake, Portsmouth, Suffolk, Newport News, Hampton and Poquoson each run their own zoning administration with their own overlays, fees and processes.
All of them are bound by section 15.2-2307, so an owner anywhere in the region has the same protected right to restore after damage and the same two-year limit on it. What differs is what the ordinance will permit once that window has closed, and that is a genuinely different answer city by city.
The Clock Is the Same Everywhere
Worth restating because it is the half owners most often assume is local. Two years from the date of the event, then the building may only be repaired, rebuilt or replaced in accordance with the ordinance as it then stands.
Nothing about crossing a city line changes that, and nothing about a slower local process extends it. The date on the fire report is the date wherever the property sits.

The Statutes That Cross Every City Line
Section 15.2-2307 binds every locality in Virginia: 2 years to repair, rebuild or replace, a 2 year discontinuance limit, a right to restore where damage exceeds 50 per cent, and forfeiture where square footage is enlarged.
The Uniform Statewide Building Code at section 36-97 and following applies identically region-wide, and section 15.2-2310 governs variances. Virginia Beach's own overlay sits at Article 18 and section 1804 and stops at the city line.
