Worth saying plainly because owners across the city read about the Oceana overlay and assume it reaches them.
The accident potential zones follow approach and departure corridors, and much of the northern half of the city sits outside them. Much of this housing was platted and built under rules close enough to current ones that the structures conform. A conforming house is not relying on section 15.2-2307 at all, which removes both clocks from the file.
That is the single biggest difference between a fire file here and one at the Oceanfront, and it is worth establishing early because it changes what you are actually negotiating about.
How Do I Find out Whether Mine Conforms?
We publish no conformity determinations, zone findings or values for individual properties in the northern part of the city. The zoning administrator and local sale evidence answer those.
The Clock Still Exists Where It Applies
Where a structure is nonconforming, everything in the state statute applies here exactly as it does elsewhere in Virginia. Two years to repair, rebuild or replace, two years of discontinuance capable of ending the status, and forfeiture where the square footage is enlarged or the building structurally altered.
None of that varies by locality. Only the zoning does, and the building code does not vary at all.
Waterfront Parcels Add Their Own Questions
Along Lynnhaven and the bay, floodplain regulations adopted as a condition of participating in the National Flood Insurance Program apply to any work done to repair, rebuild or replace a building, and the statute says so expressly.
That is a separate set of requirements from the zoning and from the building code, and on a waterfront parcel it is worth asking the city about specifically rather than assuming the zoning answer covers it.

The Provisions That Still Reach the Northern City
Section 15.2-2307 applies wherever a structure is nonconforming: 2 years to repair, rebuild or replace, a 2 year discontinuance limit, and a right to restore where damage exceeds 50 per cent.
The Uniform Statewide Building Code at section 36-97 and following applies identically across the state, and noise attenuation is required for new residential construction within the mapped noise zones under Article 18.

Does the Two-Year Clock Apply to Me?
Only where the structure is nonconforming. On a conforming house you are in the ordinary permission system instead.
